By registering as a vendor at The Funky Flea Market, you acknowledge that you have read, understood, and agree to be bound by the following Terms and Conditions. These terms apply to all vendors participating in any Funky Flea Market event, whether for a single date or on a recurring basis.

1. Booth Fees and Payment

​

​Booth fees are charged on a per-table basis. Vendors are responsible for payment in full prior to or upon arrival at the market. Payment will not be deferred until sales are made on the day of the event, under any circumstances.

​

Accepted payment methods are as follows:

• E-transfer to pay@thefunkyflea.ca

• Cash, paid directly to market staff

​

Vendors who have not paid in advance must settle their booth fee upon arrival on the day of the event, when staff approach. Failure to pay upon arrival may result in forfeiture of the vendor's assigned space without refund of any prior payments or refusal of future participation at the market.

2. Cancellations and Refunds

​

Vendors who need to cancel their participation must notify The Funky Flea Market no later than 11:59 PM on the Friday immediately preceding the Sunday market date. Cancellations received by this deadline will be eligible for a full refund of any booth fees paid.

​

Cancellations received after the Friday deadline, or failure to appear on the day of the event without prior notice, will be considered a no-show. No refunds will be issued for late cancellations or no-shows. The Funky Flea Market reserves the right to reassign any vacated or abandoned space at its discretion.

3. Setup and Teardown

​

All vendors must be fully set up and ready to sell at their assigned table by 9:00 AM. Late arrivals that result in a vendor not being ready by this time may forfeit their space for that event without refund.

​

Teardown may not begin before 3:00 PM, which is the official market closing time. Early teardown disrupts the experience for customers and other vendors. Vendors who begin packing down their booth before 3:00 PM may be subject to restrictions on future participation.

​

Vendors are responsible for leaving their assigned space in the same condition in which it was found. Any damage to the venue or surrounding areas caused by a vendor or their customers may be the financial responsibility of that vendor.

​

4. Vendor Conduct

​

Vendors are expected to conduct themselves in a professional and respectful manner at all times, toward fellow vendors, customers, and market staff. The Funky Flea Market operates within a rented venue, and all vendors are expected to respect the rules and property of that space.

​

The following standards apply to all vendors:

• Vendors are responsible for the conduct of any assistants or guests accompanying them at their booth.

• Disputes between vendors must be brought to the attention of market staff and must not be handled in a manner that disrupts the market environment.

• Vendors must keep their designated space tidy and contained throughout the event.

• Disruptive, threatening, or abusive behaviour toward any person at the market is grounds for immediate removal without refund.

5. Prohibited and Restricted Goods

​

Vendors may not sell counterfeit, bootleg, or unlicensed goods, including but not limited to unauthorized reproductions of branded merchandise, pirated media, or items infringing on the intellectual property rights of any third party.

 

Funky Flea Market reserves the sole and absolute right to determine whether any item offered for sale is inappropriate, offensive, or otherwise unsuitable for the market environment. This includes, without limitation, items that the organizers deem to be harmful, inflammatory, or disruptive to the experience of other vendors or attendees. Vendors may be asked to remove such items immediately, and failure to comply may result in removal from the event without refund.

 

This provision applies regardless of the historical, educational, or collector context claimed for any item. Vendors who are uncertain whether a particular item is permissible are encouraged to contact the organizers in advance of the event date.

 

Handmade and original goods are welcome. Vendors selling handmade items are not subject to restrictions on creative content beyond the general conduct and appropriateness standards outlined in these terms.

6. Photography, Filming, and Social Media

​

By participating in The Funky Flea Market, vendors consent to being incidentally captured in photographs or video footage taken for the purpose of promoting the market on social media and other channels. This includes footage of the market floor, vendor displays, and the general atmosphere of the event.

 

The Funky Flea Market will not approach vendors directly for on-camera interviews or close-up filming without first obtaining the vendor's permission at the time of filming. Incidental background footage does not require individual consent beyond the general agreement set out in these terms.

 

Vendors who do not wish to be included in any promotional content must notify market staff at the start of the event. We will make reasonable efforts to accommodate such requests.

7. Liability

​

The Funky Flea Market and its organizers are not responsible for any loss, theft, or damage to vendor merchandise, equipment, or personal property, whether occurring before, during, or after the event.

 

Vendors participate at their own risk. The Funky Flea Market does not carry insurance covering vendor goods or vendor liability to customers. Vendors are solely responsible for any claims, disputes, or transactions arising from the sale of their goods.

 

The Funky Flea Market is not liable for any injury sustained by a vendor or their assistants at the event, to the extent permitted by applicable law.

8. Right to Refuse or Remove

​

Funky Flea Market reserves the right, at the sole discretion of the organizers, to refuse participation to any vendor or to remove a vendor from an event at any time. Grounds for refusal or removal include, but are not limited to, violation of any provision of these Terms and Conditions, conduct deemed harmful to the market or its attendees, or failure to pay applicable booth fees.

 

Vendors removed for cause will not be entitled to a refund of any fees paid. The Funky Flea Market also reserves the right to restrict future participation of any vendor who has violated these terms.

9. Amendments

​

Funky Flea Market reserves the right to amend these Terms and Conditions at any time. Vendors will be notified of material changes prior to their next event participation. Continued participation in the market following any amendment constitutes acceptance of the updated terms.
